Consignment Agreement

    Trendy Tots: A Modern Children's Consignment Store is committed to offering top quality
    trendy children's clothing at a fraction of the cost. We work with consignors who are committed to offering
    quality children's items and benefit by receiving a portion of the profit once an item has successfully sold.
    Trendy Tots is grateful for each participating consignor and will make every effort to ensure that each item
    consigned has the best opportunity to sell so that everyone involved is happy. Below is Trendy Tots
    Consignment agreement:

    - Trendy Tots requires an appointment for all consignment. Trendy Tots will offer 20 consignment
      appointments each week on a first come first serve basis. (morning, afternoons, early evenings, and
      weekends.)

    - Trendy Tots offers 90 day consigning periods for all consigned items. Through the 90 days of a consignment
      period all items are the property of Trendy Tots. A consignor can not pick up items before 90 days without
      permission of Trendy Tots.

    - Consignors are welcome to consign a maximum of 1 bin full of items (roughly 100 items) and a minimum of
      10 items per appointment.

    - Trendy Tots does not accept clothing with characters (i.e.: Elmo, High School Musical, Winnie the Pooh,
      Dora, etc.)

    - Trendy Tots does not accept anything that is older than 3 years.

    - Trendy Tots accepts and sells the following items for consignment:

        - Clothing, Shoes and Accessories sizes newborn through 16 youth, Juniors XS, S and Maternity.
        - Puzzles (wooden puzzles for infant toddlers)
        - Books (quality hard covered books, reader books, board books)
        - CDs, DVDs, Video Games
        - Seasonal Items

    - Trendy Tots accepts the following popular brands for consignment:

    - Trendy Tots ONLY accepts brands not included in the above list if they are New With Tags, New Without
      Tags, in EXCELLENT condition AND they must be TRENDY!!!

    - ALL items must be freshly laundered, free from stains, grease, holes, tears, pills and pet hair. Items must
      be zipped up, buttoned, ironed (when necessary). Items must be free from Pet and Smoke Odors. Shoes
      must be freshly cleaned (especially the bottom of shoes). Clothing must be neatly folded to prevent
      wrinkling while in bins. Please keep in mind transporting clothing in bags may cause items to wrinkle.

    - Hangers will be provided by Trendy Tots.

    - Trendy Tots agrees to pay 50% of the final selling price if all items consigned are brought in freshly
      laundered, free from wrinkles and ready to be placed on hangers provided by Trendy Tots. Any consigned
      items requiring any form of preparation maintenance by Trendy Tots prior to reaching the sales floor, i.e.
      steaming, buttoning, zipping etc. Trendy Tots agrees to pay 40% of the final selling price.

    - Consignors can choose to use their earnings as store credit at any time or choose to receive payment in
      the form of a check for earnings of $25.00 or more OR at the end of the 90 day cosignment period,
      whichever occurs first.

    - Consignors who choose to receive payment in the form of a check will be responsible for contacting the
      store to request a check be prepared. Any earnings unclaimed for 6 months from original consignment date
      will be claimed by Trendy Tots and the consignor account will be restored to zero.

    - Consignors may request a check be mailed and Trendy Tots will deduct $1.00 from a consignor's account
       each time a check is mailed.

    - Consignors have the option to donate / or pick up unsold items at the end of the 90 day cosignment period.

        * Donations are made on a monthly basis to the following:
            - Quest for Grace: Foster Care Families
            - Little One's Daycare: Schenectady County Daycare
            - Howe Pre-K Program: Schenectady County Pre-School
            - Schenectady County Elementary Schools
                * Anonymous Families in Need *

    - Consignors who choose to pick up unsold items are responsible for contacting Trendy Tots prior to the 90
      day end date to schedule a pick up time. Trendy Tots will provide a list of the remaining unsold items and
      the consignor will be responsible for pulling all unsold items from store racks. At the end of the 90 day
      consignment period all unsold, unclaimed items become the property of Trendy Tots and can be sold or
      donated at Trendy Tots discretion.

    - Trendy Tots reserves the right to price all items accepted for consignment and reserves the right to host
      store sales and offer discounts on all items.

    - All sales at Trendy Tots are FINAL. We do not accept returns.

    - Trendy Tots will not be held responsible or liable for any theft, damage or loss of any items held in the store.
